School owners file N11bn lawsuit against Sanwo-Olu over alleged demolition

A Lagos-based school owner, Paulin Eboagwu, along with her husband, Daniel Eboagwu, has filed a lawsuit seeking N11 billion in damages against Lagos State Governor Babajide Sanwo-Olu and six other defendants.

The suit, filed before the Lagos State High Court, centres around the alleged demolition of their school’s property in the Ilasan Lekki area of Lagos State.

The Eboagwus, in their suit (LD/15612LMW/2024), claim that the property in question was legally acquired with a valid Survey Plan No.KCO/902/006B (613/2018/LA), which had received the governor’s consent.

However, they allege that the land was unlawfully appropriated by other parties, leading to the demolition of their three-storey school complex.

The other defendants named in the suit include the Lagos State Attorney General and Commissioner for Justice, the General Manager of the Lagos State Building Control Agency, the Permanent Secretary of the Lagos State Ministry of Physical Planning and Urban Development, Sterling Oil, Chronodexia Investment Nigeria Ltd, Milind Dettatraya Kukarani, and unknown persons.

According to court documents, the Eboagwus purchased the land from the Elegushi Property and Investment Company Limited, but later faced challenges when Chronodexia Investment Nigeria Ltd and Milind Dettatraya Kukarani allegedly attempted to claim a portion of the land, citing a prior purchase by Shell Cooperative Multipurpose Society.

Despite compliance with regulatory demands and obtaining necessary approvals, the Eboagwus claim that their property was forcibly demolished by officials from the Lagos State Building Control Agency, along with armed thugs.

The plaintiffs argue that the demolition was unlawful and are seeking a court declaration of their ownership of the land, along with N11 billion in damages for the losses and emotional distress caused by the incident.

Additionally, the plaintiffs are requesting a public apology from the defendants for the distress caused, as well as a perpetual injunction to prevent further interference with their property.

When contacted for comment, Lagos State Commissioner for Information, Gbenga Omotoso, stated that he was not aware of any lawsuit against the governor.
